The following booking conditions, together with the information established on the page of YALORDE YOGA website will form the contract between you and us for your retreat with us.These terms and conditions apply equally to all participants of different nationalities. Your contract will be legislated by the justice of the Spanish state. Those who make their reservation must accept the following Terms and Conditions, Privacy Policy and Protection of Personal Data.
In this contract, a reference to “you” and “your” includes the person indicated on the confirmation invoice (who must be at least 18 years of age at the time of booking) and all persons on behalf of a reservation they are done.
We are YALORDE YOGA, which is listed as Guenther Schauer, with Foreign Identification Number Y6135110N, and Ludisis Caridad Mones Castellanos, with Foreign Identification Number Y6195943X. Both with social address: Calle Cuartelillo 6, 1º B, 18009, Granada, Granada, Spain.
1. Definition.
In this agreement, the following definitions apply unless the context requires otherwise:
- “Destinations” means the place specified by us in the travel package as the place where we will meet and begin your vacation.
- “Start date” means the date on which we meet to begin your vacation.
- “Retreat” means an event organized by YALORDE YOGA.
- “Available package” refers to the group of accommodations and activities for which you will pay.
- “Itinerary” means the sequence of activities you will carry out in the retreat.
- “Starting point” means the place from which you travel to reach our retreat destination.
- “Meeting point” means the place where we will meet at the beginning of the retreat.
- “Retreat highlights” means the most important activities you can enjoy in each retreat.
- “Yoga” is a sanskrit term that can be translated as “effort” or “union”. The concept has two great applications: on the one hand, it is about the set of physical and mental disciplines that originated in India and that seek to achieve spiritual perfection and union with the absolute; On the other hand, yoga is formed by modern practices that derive from the aforementioned Hindu tradition and that promote mastery of the body and a greater capacity for concentration.
- “Massage” is the activity that consists of rubbing, pressing or hitting with a certain rhythm and intensity different parts of the body with therapeutic, aesthetic or sporting purposes.
- “Client” means “you” in this contract and includes the person with the main name on the confirmation invoice (who must be at least 18 years of age at the time of booking) and all persons on behalf of a reservation they are done.
2. What do the retreats include?
2.1. The following items are included:
2.1.1. Accommodation and all meals (unless otherwise indicated in the itinerary).
2.1.2. Yoga retirement services as set out in the package. See our packages section to see what is included and save a copy. YALORDE YOGA reserves the right to modify, eliminate or change package elements and notify you of any changes before the start of your vacation.
2.1.3. Yoga classes, Thai Massage workshops, Dharma Talks, Meditation sessions, etc.
2.2. For our yoga retreats in Spain:
2.2.1. YALORDE YOGA provides reservation services, professional services of Masseur and Yoga instructor and retreat. This is billed and includes 21% VAT in Spain.
2.2.2. When booking your tour, understand the above.
2.3. The following items are not included:
2.3.1. Return flights to the destination of the retreat.
2.3.2. All other costs incurred before boarding the transportation at the Meeting Point and after returning to the departure point.
2.3.3. Travel insurance or any other personal insurance for you.
2.3.4. Passport and visa costs.
2.3.5. Vaccines and medications, before, during and after withdrawal.
2.3.6. Food and drink in addition to what we included in the recall.

BOOKING YOUR RETREAT / PAYMENTS & CANCELLATIONS
3. Terms of service:
YALORDE YOGA lists what is included in each retreat on the trip page. Airfare, tips, travel insurance, alcohol are rarely included.
4. Reservation:
To reserve your place on one of our trips, complete the registration form with the non-refundable deposit specific to your trip.
5. Payment:
5.1. All prices are per person and include a non-refundable deposit. Non-refundable deposits are 300 euros per person for all retreats. Note: non-refundable deposits are 200 euros for any retreat in which the price options are less than 400 euros.
5.2. Payment can be made with PayPal, Bank Transfer or credit card. The final balances expire 60 days before the departure date of the trip. If you do not think you can pay on time, contact us by email.
6. Cancellation by you:
6.1. If you wish to cancel your withdrawal you must notify YALORDE YOGA in writing. Once we have received your notice, the cancellation will take effect subject to the following:
6.2. If the cancellation takes place more than 60 days before your departure date, any payment made will be refunded less your deposit.
6.3. If the cancellation is carried out between 30-60 days before your departure, 50% of the trip price will be lost.
6.4. If the cancellation takes place less than 30 days before the departure date, 100% of the trip price will be lost.
IMPORTANT: If you do not send the full payment 60 days before the retreat, and do not cancel your registration or respond to our communication, YALORDE YOGA reserves the right to release your place. Consider travel and cancellation insurance to protect the costs of your trip in case of injury, illness or inability to attend for other reasons.
7. Waiting List Policy:
7.1. If the retreat is complete, we may add your name to our waiting list upon written request, or inform you of other available dates.
7.2. If we can confirm your place in the retreat, we will contact you and the total payment will be made immediately.
8. Refund policy:
8.1. If the participant does not wish to participate in the retreat once the same has been paid, the following refund policy applies:
8.1.2. If the balance of the retreat fee is not received before the notified due date (60 days before the start of the retreat), a participant’s place can be offered to someone on the waiting list. Participants will lose the deposit paid.
a). If the participant does not wish to participate and notifies in writing 60 days or more before the start of the retreat, the participant will receive a full refund of all the money paid, less an administration fee of 100 euros.
b). If the participant withdraws 30-59 days before the start of the event, the participant will receive 75% of the total retreat fee, less an administration fee of 100 euros.
c). If the participant withdraws 14-29 days before the start of the event, the participant will receive 50% of the total retreat fee, less an administration fee of 100 euros.
d). If the participant withdraws 1-13 days before the start of the event or withdraws after the event begins, the total retreat fee is not refundable.
e). If the participant reserves and pays for additional treatments or program options (eg massage, surfing, kayak, dance class, etc.), the cancellation made by the participant within 8-14 days prior to the start of the program, you will receive a full refund of the added option.
f). The cancellation of treatments or program options by the participant within 7 days prior to the start of the program is not eligible for a refund. Any activity (for example, surfing or kayaking) canceled by the operator due to weather conditions is fully refundable.
9. Transfer policy:
9.1. If circumstances arise that require a transfer of the retreat in which you have a confirmed reservation, you must send us a written request.
9.2. If a participant on the waiting list can fill the space, then you can transfer your place to another applicable retreat at a cost of 100 euros. This option is limited to a single transfer (after this, the regular refund policy applies) and depends on a case-by-case evaluation of your situation.
9.3. If there are no participants on the waiting list to fill the space, the regular refund policy applies to your transfer.
10. Cancellation by YALORDE YOGA:
10.1. In the rare case of a cancellation by YALORDE YOGA we will offer a transfer to another trip or a full refund of your funds. YALORDE YOGA is not responsible for any expense or damage incurred as a result of cancellation of the trip, including preparation costs, airline tickets, travel documents or other expenses.
10.2. YALORDE YOGA reserves the right to cancel any trip before departure in the event that there are very few people booked, in which case a full refund of all payments made to YALORDE YOGA will be granted. You will not be entitled to claim any additional amount or seek any compensation for injuries, losses, expenses or damages (direct or indirect) or for the loss of time or inconvenience that may result from such cancellation (including, among others, visas, charges for passport and vaccination, or departures, equipment purchases, airport and airline taxes).
11. Amendments by YALORDE YOGA:
11.1. Sometimes YALORDE YOGA can make some changes (example: class times, yoga teacher or other arrangements). YALORDE YOGA reserves the right to make changes at any time (example: yoga teachers, class schedule, other activities, etc.). In the case of accommodation change we will do everything possible to offer you a room of similar category. In case of any other major changes, we will inform you as soon as possible, if it is possible before your travel starts.
INSURANCE AND DOCUMENTS
12. Travel insurance:
12.1. YALORDE YOGA requires that each member of the trip purchase individual travel insurance for their trip for both international retreats and domestic retreats. We suggest that you include “cancel for any reason” with your policy. You must buy travel insurance that includes medical coverage. We recommend buying insurance within 1 or 2 weeks after making your first payment of the trip (ie flight or retreat reservation) to ensure the best price and the best coverage.
13. Travel documents and immunizations:
13.1. It is the responsibility of each traveler to obtain all required travel documents, including visas and other travel documents, unless otherwise indicated. Information about the necessary documentation is provided by our website or you can contact us to obtain more detailed information about the requirements of your trip. It is your responsibility to buy the correct vaccines. Please contact your nearest travel clinic to find out the most demanding requirements.
14. Your travel arrangements:
14.1. All transport costs from home to our yoga retreat are not included in the price. YALORDE YOGA is not responsible for any consequences arising from cancellations or delays of any travel company you hire, or any irregularity in the documentation required for the trip. Transportation to and from the yoga retreat is not included, unless explicitly specified.
14.2. Your health:
a). It will only be your responsibility to consult a doctor with knowledge of yoga to verify that you are in good health for yoga and other physical activities that YALORDE YOGA reserves under your request. (For example, mountain hiking, horseback riding, etc.).
b). We ask you to inform us if you have any health problems before reserving your place in our yoga retreat. If you do not inform us about your health problems, YALORDE YOGA reserves the right to cancel your reservation and will not reimburse any compensation. If you have health problems that may be affected by yoga retreat activities, YALORDE YOGA reserves the right to advise you not to participate and you may be denied participation if you believe there may be a risk to your physical or psychological health.
c). If you feel any discomfort, pain or injury during any of the activities of the yoga retreat, the activity should stop as soon as possible and you should contact a member of YALORDE YOGA. If you continue with the activities there are possibilities of an additional worsening of the injury, YALORDE YOGA reserves the right to deny your stay and participation in the yoga retreat, without returning the money.
d). Although YALORDE YOGA takes all necessary measures to ensure high standards of health and safety, some of our retreats may be located in rural areas where it is common to have uneven ground, so we are not responsible for injuries sustained as result.
e). It will be the responsibility of women who have between 12 and 28 weeks of gestation, to send a letter written by their doctor indicating that they are able to travel and that they are capable of carrying out the activities we offer. It is better that pregnant women who wish to attend yoga retreat have practiced yoga before.
14.3. Allergy to extreme foods:
14.3.1. When a food allergy is so severe that less exposure to the substance in question could cause a life-threatening reaction (for example, when the reaction can be triggered other than actually eating the food products, such as by smell alone or by tiny trace elements in the hands of a staff member or another person).The client must inform us in writing about the serious nature of the allergy before booking.
ACKNOWLEDGEMENT
15. Acknowledgment of Risks / Assumption of Responsibility:
15.1. Although YALORDE YOGA has taken reasonable measures to ensure safety, I recognize that this activity carries risks, including certain risks that can not be eliminated without destroying the unique character of this activity. The same elements that contribute to the unique character of this activity may cause loss or damage to the Participant, including accidental injuries, illnesses or, in extreme cases, permanent trauma, disability or death and may also cause damage or loss of property. Some of those risks are described below, but not all.
15.2. Activities vary from one trip to another and may include, but are not limited to: hiking, backpacking and climbing in a wide variety of environments, including rock, snow and ice; biking on trails and paths with a wide range of surface conditions and traffic volume; rock climbing, climbing climbing equipment and rope courses, using zip lines and rope swings; whitewater rafting, river kayaking, sea kayaking and canoeing; swimming, diving and surfing; fishing.
15.3. YALORDE YOGA trips can involve trips to remote places, often many hours from medical facilities. Transportation, evacuations, and medical care can be significantly delayed; communication may be delayed, limited or not available.
15.4. Environmental risks and hazards include moving, deep or cold water; insects, snakes and predators, including large animals; falling and rolling rocks; lightning, flash floods and unpredictable forces of nature, including weather, which can change to extreme conditions without notice. Possible injuries and illnesses include hypothermia, frostbite, high altitude illnesses, sunburn, heat stroke, dehydration, and other minor or serious conditions.
15.5. During the trip, participants are responsible for their own safety.
15.6. I (the trip participant) acknowledge and understand that YALORDE YOGA trips include risks of injury or death to participants. I understand that the above description of these risks is not complete and that other unknown or unforeseen risks may result in loss of property, injury or death. I agree to assume responsibility for the inherent risks identified here and the inherent risks not specifically identified. I acknowledge that participation in this activity is purely voluntary, no one is forcing participation and participation is chosen with full knowledge of the inherent risks.
15.7. I (the travel participant) assume and accept all responsibility for any injury, death, loss of personal property and expenses incurred as a result of the inherent risks and hazards identified above, and the inherent risks and hazards not specifically identified and as a result of My negligence in participating in this activity.
16. Indemnification:
16.1. The participant recognizes that there is a risk in the types of activities offered. Therefore, the participant accepts financial responsibility for any injury that the participant may cause to himself or to any other participant due to his negligence. If the parties named above, or any person acting on your behalf, must incur attorneys’ fees and costs to enforce this agreement, I agree to reimburse such fees and costs. I also agree to indemnify YALORDE YOGA, its directors, agents, employees and volunteers for the injury or death of any person and damages to property that may result from my negligent or intentional act, or omission to participate in activities offered. This includes, but is not limited to, parks, recreational areas, playgrounds, areas adjacent to the main building and / or any area selected for training.
MEDIA
17. Permit for capture and use:
17.1. The means are defined as photographs, videos, written or verbal testimonies, or any other form of similarity capture. For a valuable consideration received, I grant YALORDE YOGA the absolute and irrevocable right and unrestricted permission over any captured means that he or she has taken or may take from me or in which I may be included with others, to use, reuse, publish and republish in whole or in part, individually or in connection with other material, on any and all known publishing platforms now or in the future, including the Internet, and for any purpose, including specifically illustration, promotion, art, publishing, advertising and commerce, without restriction regarding the alteration; and use my name in connection with any use if you wish. 18. Local standards:
18.1. Laws, standards, culture and attitudes are different in many countries from what you reasonably expect at home. We are not responsible for standards of service, safety, hygiene and behavior that may be less than what you are used to or expected.
18.2. We do not make any statement or commitment that all services comply with applicable local laws and regulations and lack of compliance does not automatically mean that we, or the service provider, have it.
18.3. Keep in mind that we will only be responsible for what employees, agents and suppliers do or do not do if they were in the time acting in the course of employment (for employees) or carrying out the work we asked them to do (for agents and suppliers).
19. Complaints:
19.1. We will do our best to provide a happy and satisfying vacation, but if we fall in any case, raise any problems with your retreat leader immediately.
20. Legal warning:

WAIVER
21. Release and Waiver of Liability:

By accepting this Agreement from the travel participant, I (the travel participant) declare that I do not have physical conditions or medical precautions that negatively affect my ability to participate in the yoga program or other physical or cultural activities offered on travel. YALORDE YOGA. I fully understand that my participation in the yoga program or other activities could be detrimental to my health and voluntarily assume all risks related to such activities.
21.2. PERSONAL RELEASE By accepting the terms described here and elsewhere on the YALORDE YOGA website, I hereby release and release my rights and claims for damages that may occur as a result of participating in a YALORDE YOGA trip, including, between others, damage as a result of an occurrence, including weather, local political situations, wildlife or uncontrollable acts of God, including the risk of death. I release YALORDE YOGA, including its owners, directors, employees, guides, yoga teachers and partners, from liability for personal injury, illness, emotional damage, incurred travel expenses or property damage that may be incurred as a result of the participation in this trip.
21.3. For the benefit of everyone on your trip, YALORDE YOGA reserves the right to accept or reject any participant at any time without liability, and in case it determines, in its sole discretion, that such participant is detrimental to the harmony of the trip, can without any obligation to pay a refund or any other amount, to expel said participant from the trip. YALORDE YOGA will not be responsible for any participant who leaves the trip before its conclusion or for any activity carried out by a participant that is not included in the itinerary of the trip.
